Returns, refunds, cancellation and cooling off:

You the consumer has a cooling-off period of 7 working days in which to cancel the order. The cooling-off period commences the day after the goods are received by the consumer. Any cancellation of the order shall be made in writing to Bark UK Online Ltd, Woodlands Nursery, Biggleswade Road, SG18 9BJ within the cooling-off period.

The consumer has a duty to take reasonable care of the goods. The consumer will be entitled to a full refund for the goods, however, any goods returned to the supplier will be at the consumer's expense or at a charge not exceeding the direct delivery or haulage costs. Any complaints or cancellation of an order should be sent to Bark UK Online Ltd, Millow Hall farm,Millow, Biggleswade, SG18 8RH.

Any orders to be returned to us must be notified to us by telephone. If the products are already in transit there will be a charge of a minimum of £39.25 + vat per pallet or the actual cost of delivering and returning the goods via the Pall-Ex pallet distribution network. If the goods have to be returned because of poor access or any other reason for not being able to drop the goods then the cost of delivery will be charged for both the outward and return delivery.

 

General Terms and Conditions: Prices

The Prices for the Goods or Services include carriage, VAT, and other taxes or duties.

The Company shall have the right to adjust its prices for any increase in the price of materials, parts, labour, and transport.

Despite our best efforts, a small number of the items in our catalogue may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

 

Carriage: 

Included to mainland UK unless otherwise stated. Delivery times are shown on the product page and in the checkout area. Non-delivery or damage to goods must be notified immediately by telephone to Bark UK Online Ltd on 01767 834011 and in writing by email to sales@barkukonline.co.uk.

 

Title:

Title to the goods shall remain vested in us until payment has been made for such goods in full. We are authorised to enter any premises where such goods are stored for the purpose of exercising its rights to retake possession of goods for which payment is outstanding.

 

Conditions of Sale:

All products and materials are sold as being as nearly as possible in accordance with the Supplier's published description, specification or sample. In the event of any failure to comply with the appropriate description, specification or sample, the Supplier will replace but will not, in any event, be liable for any other loss whether consequential or otherwise.

Customers must satisfy themselves before using any material that it is suitable for their purpose and the Supplier will not be responsible for any loss incurred by the use of unsuitable material.

 

Delivery:

Delivery times are shown on the product page and in the checkout area. Most products are delivered on pallets, in which case 18-tonne lorries with a tail lift (about dustcart size) are used and a kerbside delivery only can be guaranteed. We will do our best to deliver as close to the property if access allows.

As a pallet trolley is used to unload it not possible to move pallets over loose surfaces or lift over any steps,we are not able to carry materials up paths or to rear gardens. Access to sites must be on hard roads over which a vehicle can pass without sustaining or causing damage of any kind.

It is the customer's responsibility to let us know if there are access difficulties, low bridges, narrow single lanes, weight limit roads, steep driveways or hills. Please call 01767 834011. We do not have vehicles available with cranes or forklifts.

We will make every effort to deliver products ordered on the agreed date, but if for any reason we are unable to deliver then no liability whether in damages or otherwise for delay of whole or any part of the goods ordered arising from any cause whatsoever.

Delivery shall be conditional upon access free from encumbrances and good roads being available to the company's vehicles to the place of delivery. If the delivery agent cannot gain access to the delivery address then additional costs may be incurred. In the case of kerbside deliveries, the customer, or somebody appointed by the customer, should be at the delivery point to accept the delivery unless otherwise arranged.

Force Majeure:

If the Supplier is prevented from or delayed in delivery owing to inability to obtain necessary transport, or owing to labour disputes, strikes, lock-outs, fire, accident, Act of God, breakdown of plant used in the production or delivery or from any cause the Supplier shall not be liable for any loss or damage direct or indirect caused to the buyer by reason or failure or delay by the Supplier in delivering the materials.

 

Customer's Premises:

The customer will at all times be responsible for the security and insurance of the products after a delivery has been made.

Our deliveries are all made by third party delivery company.

In the event that damage is caused to a customer’s property by a third party courier company, claims are to be made directly to the third party courier company or directly via the haulier's insurance company.

The customer will comply with all requirements of Health & Safety Legislation. For delivery made on a kerbside delivery basis it will be the customer's responsibility to move the products from the place of delivery to the area of laying. The supplier accepts no responsibility for injury or damage caused to persons, property or equipment whilst on customer's premises.

 

English Law:

These conditions and any contract or variation are governed by the law of England. Any disputes arising from these conditions or any contract or variation entered into by the company with the customer which cannot be settled in the ordinary course of business shall be referred to a single arbitrator in accordance with the arbitration act 1950 or any modification thereof for the time being in force.
